Terms of Service
Last updated: 17 September 2026. These terms are an agreement between you and TAGQA PTY LTD (ABN 45 634 337 778) of Melbourne, VIC, Australia ("we", "us") governing the SCMTR platform at scmtr.io. By creating an account or using the service you accept them.
What the service is — and is not
SCMTR is a software tool for preparing, validating, and submitting filings under India's Sea Cargo Manifest and Transhipment Regulations through ICEGATE, and for tracking the customs decisions that come back. We are not a customs broker, agent, or law firm: the platform transmits what you tell it to, and you remain solely responsible for the accuracy, completeness, and timeliness of every declaration filed through your account, and for your own registrations and credentials with ICEGATE. Customs authorities — not we — decide the outcome of a filing.
Accounts and organizations
You must be 18 or older and using the service for business purposes. Keep your sign-in method secure; actions taken through your account are yours. Organization administrators control who joins their organization and what members may do, and are responsible for those grants. ICEGATE credentials you store stay under your organization's control and are used only to submit on your instruction.
Pricing
The platform is currently provided free of charge, with every feature included and no usage caps.
Acceptable use
- No filings you are not legally entitled to make, and no knowingly false customs declarations.
- No probing, disrupting, or overloading the service, and no access to other organizations' data.
- No reselling or white-labelling the service without our written agreement.
- Only data you have the right to submit — including third parties' personal data in declarations.
The assistant is not advice
The SCMTR chatbot and every guide on this site are general information, generated or written to the best of our knowledge. They are not legal or customs-compliance advice and may not reflect the latest ICEGATE/CBIC requirements — verify against official sources or a licensed customs broker before filing.
Availability and changes
The service is provided without an uptime commitment; we may change or withdraw features as it evolves. ICEGATE's own availability and processing times are outside our control. We may suspend accounts that breach these terms, and you may close your account at any time — data handling after closure is described in the Privacy Policy.
Your data, our platform
Declaration and organization data you enter remains yours; you grant us only the rights needed to operate the service on it. The platform, its software, and its content remain ours.
Every file you upload is kept. That means declarations, acknowledgements, vessel manifests and customs' replies, on whichever screen you upload them — including the free check without signing in, and files e-mailed to our checking address. A file is kept for two years after we last receive it, or for as long as a filing in SCMTR still relies on it. You grant us the right to keep and use these files to help you when you ask, to link a filing with its replies and amendments over time, and to improve how SCMTR reads and checks files. We do not sell them, advertise with them, or use them to train AI models. Platform super administrators can open them, every opening is recorded, and you can ask us to delete a file at any time. The privacy policy sets this out in full.
Files you upload often name other people — a consignor, a consignee, a shipping line's customers. Upload only files you have the right to share with us for these purposes.
Liability
The service is provided "as is" to the fullest extent Indian law allows. We are not liable for customs penalties, rejected or late filings, or business losses arising from your declarations, from ICEGATE's decisions or downtime, or from events beyond our reasonable control. Where liability cannot be excluded, it is limited to the amount you paid us for the service in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
Governing law and disputes
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have exclusive jurisdiction — without limiting any consumer or data-protection rights that the law of your own country (including India's DPDP Act) grants you and that cannot be contracted away. If any clause is found unenforceable, the rest stand. If these terms change materially, the next time you sign in or open a signed-in page you will be shown what changed and asked to accept it before you carry on using the service.
